Human Rights Application
A human rights application is one which is based on human rights and compelling compassionate reasons as to why the Home Office should grant you leave to remain in the UK. It is often based on Article 8 of the European Convention of Human Rights (ECHR) where is it argued that any removal from the UK would result in a breach of the UK’s obligation under this article. Reasons to apply under this could include if you have a British child or other exceptional circumstances.
The visa can be granted for a period of 30 months which will subsequently need to be extended provided the circumstances in which you were granted the visa remain the same. After you have completed a period of 10 years, you may be eligible to apply for indefinite leave to remain subject to satisfying certain criteria.
