Domestic Violence (not legally aided) Application

A domestic violence application allows you to apply for indefinite leave to remain on the basis of suffering domestic violence which has led to your relationship irretrievably breaking down. You can apply for this if you are currently in the UK as a partner of someone who is British, settled, an EEA national with pre-settled status, a Turkish national with leave to remain as a worker/business person granted before 1 January 2021 or have leave to remain in the UK as a refugee or humanitarian protection and unfortunately suffered domestic violence.

Domestic violence can include, but is not limited to, the following types of abuse: psychological, physical, sexual, financial or emotional. If you have no funds available, you can apply under the Migrant Victims of Domestic Abuse Concession whereby you would be granted leave to remain outside the immigration rules for a period of 3 months and will be able to claim benefits. You must then submit your domestic violence application before the expiry of your visa.

Who can apply for a Domestic Violence (not legally aided) Application?

To apply on the basis of being a victim of domestic violence, you generally must meet the following requirements:

  • Be the partner of someone who is British, settled, an EEA national with pre-settled status, a Turkish national with leave to remain as a worker/business person granted before 1 January 2021 or have leave to remain in the UK as a refugee or humanitarian protection.
  • Evidence that prior to the domestic violence, you were in a genuine subsisting relationship.
  • Demonstrate that your relationship has broken down irretrievably as a result of domestic violence.
