Discretionary Leave to Remain Application

A discretionary leave to remain application is one which is based on circumstances not covered by any other existing applicable immigration categories. This is often defined as being outside the immigration rules. Reasons to apply under this could include exceptional circumstances where applicants may have health issues or children. The visa can be granted for a period of 30 months which will subsequently need to be extended provided your circumstances in which you were granted the visa remain the same. After you have completed a period of 10 years, you will be eligible to apply for indefinite leave to remain subject to satisfying certain criteria.
