Adoption Applications
We understand where children are involved, immigration processes can be stressful for not only the children but also the parents wishing to adopt the child. These cases are often complex and are subject to a great deal of scrutiny from the Home Office given that the welfare and best interests of the child will be examined in detail. There are different ways in which a child can be adopted which can also vary depending on the country from which they are being adopted from. This can include adoptions under the Hague Convention, overseas adoptions recognised by UK law, overseas adoptions not recognised by UK law and de facto adoptions.
In most cases, you would need to contact your local council to be assessed to ensure they are satisfied that you are a person suitable to be able to adopt a child. Successful child applicants could be granted leave to remain in the UK, indefinite leave to remain or may even be eligible to be able to register as British or apply for a British passport based on the circumstances of the case.

Who can apply for an Adoption Application?
To apply for an adoption application, you generally must meet the following requirements however not all of the below will be applicable depending on the circumstances of your case:
- The child that you wish to adopt should be under the age of 18 and not living an independent life (i.e. they should not be married or have ever been married).
- The child’s both parents must provide consent for the adoption unless they cannot be found, lack the mental capacity to provide consent or the child would be at risk if not adopted.
- The person wishing to adopt the child should be aged 21 or over and must have a fixed and permanent home in the UK. You must also be assessed as eligible and suitable by an adoption agency in the UK to be able to adopt the child.
- The adoption should be in the best interest of the child.
- The person wishing to adopt the child should have adequate accommodation in the UK and should also be able to financially maintain the adopted child.
- If the parents wishing to adopt the child have been living with the child abroad, they must have lived with the child for at least 18 months within the last 12 months of applying and must have assumed the role of the child’s parents. The child should also have no contact or ties with their biological parents.
