European Union Settlement Scheme Family Permit
Although the UK has left the European Union, eligible family members including spouses, civil partners, children under the age of 21, unmarried partners (where they have a document from the Home Office confirming their relationship) and dependent parents may still be able to join their qualifying European family member in the UK even where they are not themselves European nationals.
The European national you wish to join should have been resident in the UK prior to 31 December 2020. If the application is successful, you would be granted a family permit valid for 6 months. You would subsequently need to submit an application for pre-settled status whereby you would be granted leave to remain for a period of 5 years. Thereafter, subject to satisfying certain criteria, you would be eligible to apply for settled status (indefinite leave to remain).

Who can apply for a European Union Settlement Scheme Family Permit?
To apply for a European Union settlement scheme family permit, you generally must meet the following requirements:
- Be outside the UK when you submit your application.
- You must be an eligible family member such as a spouse where you married before 30 December 2020 or a child under the age of 21. There are other family members that may be eligible depending on the circumstances.
- Be a family member of someone who is from the EU, Switzerland, Norway, Iceland, Liechtenstein and was resident in the UK prior to 31 December 2020.
