European Union Pre-settled and Settled Status Applications
Since the UK has left the European Union, if you were from the EU, Switzerland, Norway, Iceland, Liechtenstein and you were residence in the UK prior to 31 December 2020 (or you qualify as a family member of an eligible person and are in the UK), you would need to apply under the EU Settlement Scheme by 30 June 2021 to confirm your right of residence in the UK. If you had completed a period of 5 years residence in the UK, you would be granted settled status (indefinite leave to remain) whereas those living in the UK for less than 5 years would be granted pre-settled status which is a visa for a period of 5 years.
After completing 5 years’ residency in the UK, you can submit an application for settled status although the Home Office currently would look to automatically grant you this if they are satisfied that you meet the requirements from your National Insurance records for example. You can still submit a late application if there are reasonable grounds as to why you did not apply before the deadline.
We have the experience and knowledge to assist you with your European Union pre-settled or settled status application. It is important to prepare the application comprehensively to avoid the possibility of any refusal.
To discuss how our experienced immigration lawyers can assist you with your application please call or email us. Alternatively, you can complete the online enquiry form and we will contact you. Our immigration lawyers can help you by phone, videocall or see you in person at our offices in either Birmingham or London.
